1. Acceptance of These Terms
These Terms of Service ("Terms") govern access to and use of the BakeIQ website, application, tools, and related services (the "Service"). The Service is operated by BakeIQ ("BakeIQ," "we," "us," or "our").
By creating an account, starting a trial, using the Service, or accessing the Service on behalf of an organization, you agree to these Terms. If you use BakeIQ for a bakery, company, or other organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, do not use the Service.
2. Accounts and Access
You must provide accurate account and organization information and keep it current. You are responsible for maintaining the confidentiality of passwords, PINs, device passwords, and other credentials.
Owners and managers are responsible for choosing user roles, location access, delivery access, and permission settings for their team. Activity performed by users in your organization may be treated as activity authorized by your organization.
You must promptly notify us at support@bakeiq.ai if you believe an account, PIN, device, or credential has been compromised.
3. Trials, Subscriptions, and Billing
BakeIQ may offer free trials, demos, promotional access, or paid subscription plans. Trial length, included features, limits, and pricing may vary by offer and may change over time.
Paid subscriptions renew automatically unless cancelled before the renewal date. Subscription fees, taxes, billing periods, and renewal terms are shown at checkout or in account billing settings. Payments are processed by third-party payment providers such as Stripe.
You may cancel a subscription according to the cancellation options available in the Service or by contacting support. Unless required by law or stated otherwise in a written agreement, fees already paid are non-refundable, and access continues until the end of the current paid period.
4. Customer Data and Privacy
You retain ownership of data you or your users enter, upload, import, or generate in BakeIQ, including recipes, ingredients, supplier records, production plans, inventory records, wholesale customers, orders, invoices, delivery records, staff schedules, timesheets, and other bakery operating data ("Customer Data").
You grant BakeIQ a limited right to host, process, transmit, display, back up, and otherwise use Customer Data as needed to provide, secure, support, and improve the Service.
You are responsible for the accuracy, legality, and appropriateness of Customer Data, including any personal information, employee records, customer information, supplier information, allergens, nutrition details, payroll information, and imported files you provide.

5. Acceptable Use
You agree not to, and not to allow others to:
- Use the Service for unlawful, fraudulent, harmful, or abusive purposes.
- Access or attempt to access accounts, data, systems, or networks without authorization.
- Interfere with, disrupt, overload, probe, scan, or test the vulnerability of the Service.
- Upload malicious code, malware, or content designed to damage systems or data.
- Reverse engineer, decompile, disassemble, scrape, or copy the Service except where allowed by law.
- Resell, sublicense, rent, or provide the Service to others without written permission.
- Use the Service to violate privacy, employment, food safety, consumer protection, tax, or other applicable laws.
6. Service Operation and Third-Party Tools
BakeIQ is an operational tool. It can help calculate production needs, track inventory, process imports, generate reports, assist with supplier ordering, support wholesale and delivery workflows, and organize staff scheduling and timekeeping. You remain responsible for reviewing outputs before relying on them.
The Service may include AI-assisted import, extraction, cleanup, help, image, or drafting features. AI-assisted outputs may be incomplete, inaccurate, or require human review. You are responsible for checking imported data, generated content, labels, nutrition details, costs, quantities, schedules, payroll records, and other outputs before use.
The Service may rely on third-party providers for hosting, databases, payments, email, maps, address lookup, file processing, AI tools, analytics, diagnostics, or support. Third-party services may be subject to their own terms and availability.
We work to keep BakeIQ available and reliable, but we do not guarantee uninterrupted or error-free access. We may update, maintain, suspend, change, or discontinue features, including beta or coming-soon modules, as the product evolves.
7. Disclaimers and Limitation of Liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.
BakeIQ is not a substitute for professional legal, tax, accounting, payroll, food safety, employment, nutrition, allergen, or regulatory advice. Your bakery is responsible for confirming that records, labels, policies, pay practices, food safety practices, and business decisions satisfy applicable requirements.
To the maximum extent permitted by law, BakeIQ will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, business interruption, loss of goodwill, or loss of data.
To the maximum extent permitted by law, BakeIQ's total liability for all claims related to the Service will not exceed the amounts paid by you to BakeIQ for the Service in the twelve months before the event giving rise to the claim.
8. Suspension, Termination, and Data Retention
You may stop using BakeIQ or request account closure at any time. We may suspend or terminate access if you violate these Terms, fail to pay applicable fees, create security or legal risk, misuse the Service, or if continued access could harm the Service, other customers, or third parties.
After cancellation or termination, data may be retained for a limited period to support reactivation, backups, legal compliance, dispute resolution, fraud prevention, and legitimate business needs. Our general retention practices are described in the Privacy Policy.
Sections of these Terms that by their nature should survive termination will survive, including payment obligations, ownership, acceptable use restrictions, disclaimers, limitations of liability, dispute terms, and governing law.
9. Intellectual Property, Indemnity, and Governing Law
BakeIQ and its licensors own the Service, including software, interfaces, designs, workflows, templates, trademarks, logos, documentation, and other materials, except for Customer Data. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business operations.
You agree to indemnify and hold BakeIQ harmless from claims, losses, liabilities, damages, costs, and expenses arising from your Customer Data, your use of the Service, your violation of these Terms, or your violation of applicable law or third-party rights.
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts located in Alberta, Canada will have exclusive jurisdiction, except where applicable law requires otherwise.
10. Changes and Contact
We may update these Terms from time to time. If a change is material, we will take reasonable steps to notify customers, such as updating this page, changing the last updated date, sending an account notice, or displaying a notice in the Service.
